นโยบายกัญชาเสรีของพรรคภูมิใจไทย: ผลกระทบต่อหลักการคุ้มครอง สิทธิเด็กและเยาวชนภายใต้รัฐธรรมนูญไทย
บทคัดย่อ
บทความวิชาการนี้มีวัตถุประสงค์เพื่อวิเคราะห์ความสอดคล้องและผลกระทบของนโยบายกัญชาเสรีของพรรคภูมิใจไทยต่อพันธกิจของรัฐในการคุ้มครองสิทธิ สวัสดิภาพ และการพัฒนาของเด็กและเยาวชนภายใต้รัฐธรรมนูญแห่งราชอาณาจักรไทย รวมถึงหลักจริยธรรมความรับผิดชอบทางการเมืองต่อผลกระทบทางสังคม การศึกษานี้เป็นการวิจัยเชิงเอกสาร โดยวิเคราะห์ข้อมูลจากกฎหมาย นโยบายสาธารณะ และเอกสารทางวิชาการที่เกี่ยวข้อง ภายใต้กรอบแนวคิด ได้แก่ ทฤษฎีจริยธรรมแห่งความรับผิดชอบ หลักประโยชน์สูงสุดของเด็ก หลักนิติธรรม และทฤษฎีนโยบายสาธารณะ ผลการศึกษาพบว่า การดำเนินนโยบายกัญชาเสรีในปี พ.ศ. 2565 มีลักษณะของการผลักดันนโยบายอย่างเร่งรัดโดยเน้นการรักษาสัญญาทางการเมืองเป็นสำคัญ ขณะที่การประเมินผลกระทบต่อเด็กและเยาวชนยังไม่ครอบคลุมเพียงพอ ส่งผลให้เกิดสภาวะสุญญากาศทางกฎหมายในช่วงเปลี่ยนผ่าน ซึ่งสะท้อนถึงความไม่สอดคล้องกับหลักนิติธรรมและหน้าที่เชิงบวกของรัฐในการคุ้มครองสิทธิเด็ก นอกจากนี้ยังพบความลักลั่นระหว่างเป้าหมายเชิงเศรษฐกิจกับหลักประโยชน์สูงสุดของเด็ก อันนำไปสู่ความจำเป็นในการบูรณาการจริยธรรมทางการเมือง การกำกับทางกฎหมาย และการคุ้มครองเด็กในการกำหนดนโยบายสาธารณะอย่างยั่งยืน
